These Terms of Service govern your use of JML Tech Studios' website and services. Please read them carefully before using our site or making a purchase.
Acceptance of Terms
By accessing jmltechstudios.com, submitting an inquiry, or purchasing a product, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. We reserve the right to update these terms at any time, with changes effective upon posting.
Services
JML Tech Studios provides creative services including video production, photography, website design, AI systems, brand launches, and event coverage. All service engagements are subject to a separate project agreement or statement of work that governs scope, deliverables, timelines, and payment. These Terms of Service govern the general use of this website and purchases of digital and physical products.
SMS Messaging Program
When you separately opt in, JML Tech Studios may send recurring automated SMS or MMS messages about project updates, appointments, services, and occasional promotions. Message frequency varies, up to 4 messages per month. Message and data rates may apply. Consent is optional and is not a condition of purchase. Reply STOP to unsubscribe at any time or HELP for help; you may also email info@jmltechstudios.com. Carriers are not liable for delayed or undelivered messages. Mobile numbers and SMS opt-in data are handled as described in our Privacy Policy and are not shared with third parties or affiliates for their marketing or promotional purposes.
Products & Store
Digital products (including plugins, templates, asset packs, and guides) are delivered electronically and include a non-exclusive, non-transferable license for personal or commercial project use; they may not be resold, redistributed, or sublicensed. Physical products are sold as described on their product and checkout pages, subject to availability and any product-specific terms shown before purchase. Eligible refunds and returns are handled according to our Return Policy.
Oneira Preorders
Oneira preorders are available only for delivery to eligible addresses in the United States and are charged in full at checkout. You have 24 hours after purchase to request a cancellation or correction. After that window, JML may begin production allocation; once allocation begins, the order is final, and after shipment there are no change-of-mind returns or preference-based exchanges. JML plans to begin shipping the first production batch no later than December 24, 2026, but each accepted order will show its own promised ship-by date, intended to be no later than March 31, 2027. Batch start is not a Christmas delivery guarantee. Delay, material-change, nonfulfillment, transit-damage, wrong-item, written-warranty, and non-waivable legal remedies remain available as described in the Oneira Preorder Terms, Return Policy, and Oneira 90-Day Limited Hardware Warranty, all of which are incorporated into these Terms.
Intellectual Property
All content on this website — including text, design, code, videos, and imagery — is owned by JML Tech Studios or its licensors and protected by applicable copyright law. You may not reproduce, distribute, or create derivative works without explicit written permission. For custom client work, ownership of final deliverables is transferred upon receipt of full payment as specified in the project agreement.
Payment
Payments are processed through Stripe and prices are listed in USD. We may use payment-processor screening and reasonable order verification, decline or cancel and refund a transaction that appears unauthorized or fraudulent, and preserve order, delivery, product-identifier, correspondence, and inspection records needed to answer a payment dispute. If a payment is reversed before fulfillment, we may place fulfillment on hold or cancel the order. If both a refund and a payment reversal are issued for the same amount, we may seek correction of the duplicate recovery where lawful. Customers are encouraged to contact info@jmltechstudios.com promptly so we can investigate, but nothing in these Terms waives a lawful right to report unauthorized use or dispute a charge through a card issuer.
Limitation of Liability
JML Tech Studios shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or products. Our total liability for any claim shall not exceed the amount you paid for the specific product or service giving rise to the claim. Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
Prohibited Use
You may not use our website or products to: violate any applicable law or regulation, infringe the intellectual property rights of others, transmit harmful or malicious code, attempt to gain unauthorized access to our systems, or use our products to create content that is illegal, defamatory, or harmful. We reserve the right to terminate access for violations.
Governing Law
These Terms of Service are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in Dallas County, Texas. If any provision of these terms is found unenforceable, the remaining provisions remain in full effect.
